Summary

The Breckinridge County Fiscal Court met for its regular session, opening with the pledge, prayer, and roll call showing all magistrates present. The court approved the minutes, fund transfers, and monthly claims, though it withheld payment on a claim from G&N Excavating because a culvert/box-cover job on a road project was not completed to bid specifications — the court will review a possible change order with state approval before paying that bill.

KYTC District 4 Engineer Brad Bottoms presented the annual Rural and Secondary road funding program, noting that state motor fuel tax revenue is down sharply (about $885,000 statewide), limiting paving this year to routine maintenance and a short resurfacing stretch of KY 110. Magistrates raised concerns about rough sections of roads including KY 86, KY 110, and KY 144, and about a weight-restricted bridge at Stephensport, but were told state funding for those fixes is not available until at least 2028. The court approved the funding plan as presented.

Road Supervisor John reported that due to election-year budget restrictions, the paving contractor may not be able to finish planned work in the 4th and 5th districts until after the new year, and that crews are moving into a lengthy repair project in the Rough River Lake Forest area. The court also discussed patching/chip-sealing options for a road near Stevensport and confirmed no new chip-and-seal work will happen until after January.

Much of the meeting focused on shifting funds to cover a shortfall in the Sheriff's Department budget (pulling from salary, overtime, incentive, animal shelter, and grant line items) and approving related items: the sheriff's amended 2026 budget, deputy/assistant salary amendments, the 2024 tax settlement audit, and the annual increase of the sheriff's revenue bond to $750,000. Discussion also covered the county's Flock license-plate camera program, with the sheriff defending its use as reserved for specific cases (missing persons, stolen vehicles, wanted persons) rather than general surveillance.

Other business included approving the former county clerk's excess fee settlement and returning excess fees to the new clerk's office, a one-year pay raise for a grounds maintenance employee, surplus declarations for several vehicles and the recycling center's baler (accepting whichever bid includes free removal), and setting the new starting salary of $40,000 for incoming Emergency Management Director Kevin Mahoney. A motion to hire an additional road department truck driver was withdrawn amid budget concerns, and the detention center's Stericycle contract renewal was tabled pending paperwork. The court signed a proclamation recognizing October 4th as '10-4 Day' for child abuse awareness, heard concerns about poor conditions at the animal shelter, and discussed splitting county Flex Fund road money, before adjourning and scheduling the next meeting for October 19, 2026.

At this time, I'll call meeting have a roll call, please. — Square Armstrong, Square Beon, Square Greenwell, Judge Lucas, Square Albbright, Square, Square Hy. [snorts] — Okay. [clears throat] Let the record reflect everyone is present this morning. First item in business is approval minutes of the August 17, 2026 meeting. And I'll entertain motion to approve those minutes. Move so motion. Square Greenwell. Is there a second? I'll second Armstrong. Any questions? Hearing [snorts] none. Take please.

  • 1:14

    — Square Armstrong. Square Babin. Yes. — Square Greenwell. Judge Lucas. Square Alberite. — Yes. — Square Moore. Yes. Square Henny. — Yes. — Yes. The minutes approved. Next item is transfers and I'll entertain a motion to approve transfers. — I'll move so motion square all rights or a second. — I'll second more. Any questions? — Hearing none, please. — Square Bevon. — Yes. — Square Greenwell. Yes. — Judge Lucas. Square Alberite. Yes. — Square Moore. Yes. — Square Henning. — Yes. — Square Armstrong. — Yes. — Transfers. Next item for [snorts] claims. I'll entertain a motion to approve claims. — I move, sir. — Okay. Motion scar all rights or second. — I'll second it. — Okay. Second squar. Any questions? — Uh can we withhold a claim out of this? — Yeah, if you want to. — The uh the GN excavating for Richard Lord. That's not the job's not done, right? — I've got the check in my desk. He won't get money until he's it's done. I just assume not approve it until it's it's done. Did they uh — I don't know what the difference would be. He's not going to get the money

  • 2:28

until he comes and finishes. — Well, [clears throat] I mean, if we approve it to be paid, I don't I don't feel comfortable with that. But did we uh Wasn't there supposed to be a box concrete box score? — There was supposed to be. He changed the design because of it had washed out around the tile and so forth. — Okay. So, if um if we don't put the box, well, they didn't put the box cover, is that going to be a problem? Get reworks from the state. — No, that will be a problem. But if you want, we'll exclude that. That's no big deal at all. — Well, I mean, I would like it excluded, but I'm also concerned about reimbursement on the back side. They didn't do it the way the state had said that it needed to be done. — Everything's out. I think if the bid was for box cover and that's not what we got, then that's a problem. — Well, that's no problem. — So, I would definitely right now there wasn't an approval from the to change it. — Okay. — We had to bid it out and that's the bid we chose and he didn't follow through with the contract. — Could you guys speak up so we can hear you? — Yes. So, the there is a claim that they're questioning whether or not it should be paid on putting in a culvert. The way the covert was done is not how

  • 3:42

it was originally bid. So at this point, my recommendation is to not pay that claim. — Correct. — And then we will have to go back and review and address that. — Thank you. — Yep. You're welcome. — So could he submit a change order — to change it to the — I think so. I mean, we'll have to go back and review. — Yes. Paperwork and court approval. — Okay. — Well, metal tiles don't hold up here like concrete. I mean them metal tiles won't bust out. — Well, this is a coated one. If you looked at why the concrete first place, — right? Exactly. — Okay. If you want to exclude that gin, that's no problem. — I mean, I'd let him know before he does any further. If he needs to replace that, tire it back out, he don't need to go any further. — Well, long as the state approves it, I mean, it's not really up to us, I guess, as far as that part goes. — Yeah, we got to approve it to change order. We'll have to approve the change order, but as long as the state approves the process, it shouldn't be in problem. — I think we probably need to contact the state and see if they're going to approve it in the first place. — Yeah. Either way, I mean, I I think it should definitely been done to the bid specs, but regardless, it wasn't and the job's not done, so I feel like we should

  • 4:56

withhold that plate. — Okay, — let's use our microphone so everybody can hear. — There you go. — I got mine turned on. I got you. — I can't hear very. I feel sorry for you. I feel the same way. — Everybody's mic. — I got a hearing aid and I still can't hear. — I've tested everybody's microphone. The only one that's not working is microphone number one. Jeremy's playing loud, I think. So, — speak up. — Does that need to be in the form of a motion to withhold that claim? — Just amend the motion. If David, if you're okay to amend the motion to not approve the single claim to the GN. — Yes. — And Shane, you — Yes, I agree. — Okay. Good. — We've already approved those. — We approve. It won't It won't hurt us. It's going to eventually have to be paid. — Okay. — What the transfer is just for that specific claim? — Yes. — We don't need to transfer it if we're not going to pay the deal, — right? — Well, we'll have to [clears throat] pay the bill one of these days, I'm sure. — Yeah. But okay. — I don't think we're going to do that. — I wouldn't think. I mean, if he's going to have to tear it down and redo it, it's going to be — probably till I mean, it's going to be a long time before they get that job. — So,

  • 6:10

    — okay. So, we we have a motion, an amended motion. So, any other disc? — I have a question for Tara. Uh, all your fuel bills I of course I know fuel's high. Um, is that mostly your — recycled go? Um there's just a few that's not — coming out the recycle line item. — The 5217 I believe shown is the — is all the the transport recycle. — All right. — Oh, I thought you were saying it was the — very few there's maybe four or five tickets I think for the other line item. — Okay. — Trans. Any other questions? [clears throat] Hearing none. Take please. — Square Greenwell. Yes. Judge Lucas. Square Albbright. Square Moore. Yes. Square Henning. Yes. — Square Armstrong. Square Bev. — Yes. [snorts] — Oh yes. The amended claims are approved. First item of new business is the Kentucky Transportation Cabinet Rule and Secondary Program. Mr. Brads. — Good morning. [clears throat] — Morning. — You said that button. — Good morning, judge and members of fiscal court. Uh again, my name is Brad

  • 7:24

Bottoms. I'm the chief engineer for KYC District 4 and we cover county and 10 other counties in the general area here. So, I got [snorts] with me today Perry, our superintendent for for the county folks here. Um main purpose of being here today is to discuss our rural secondary program. This is what we come yearly and present to you all. Uh I think you'll have in your packets their own handouts. Uh but just a reminder that the rural secondary program is funded by 22.2% 2% of the motor fuel tax receipts in the state. Uh these funds are allocated to all 120 counties based [snorts] on a fivepoint formula. 1/5if of that money goes equally to all counties. 1/5 is based on rural population. 1/5 is based on road miles and two fifth is [snorts] based on land area. And then money allocated to any particular county and only is not transferable to another county. It has to say county. Um the rural secondary system uh that the state maintains in the county is about 185 miles. That's a little over half of our total mileage in the county uh that these funds help maintain and keep up. Um [clears throat] our priority number one for the for this fiscal year is just our routine maintenance and traffic control of of all 185 miles. [snorts] That's $672,200.

  • 8:38

Uh, prior to number two is, uh, in some counties is the county judge executive expense. Uh, Judge Lucas, I think you've forgotten that for the last couple years, $3,200. Uh, so that's a zero. Priority number three is the flex fund amount that goes to the county of $214,517. And then priority number four is a section of Kentucky 110 from the Ohio County line to the 3 mile marker. Uh, so exactly 3 miles base failure repairs and resurfacing. uh $412,491. Total for the program this f this year is $1,299,28 and there's a map on the second page there that shows us [clears throat] exactly where that section of payment will be. So, um we're hoping for additional funds next year due the various issues this these past couple years. These dollars are lower than we're used to seeing and I know it's I know you all are working with the same thing there. So, uh, so hopefully next year we have a little catch-up money and we can do a little bit more paving next year, but this is the budget we have available this year for this system. So, any questions on the rural secondary program? — I'm assuming all — I'm assuming all all the counties got cut pretty much, right? — Yes. Yeah, all the counties got cut. Our
