budget transfers as presented motion by neil second second by brian all in favor next we have a petition to adopt wells green road and portion of jenny greenway to county road list jeremy you want to yes thank you all right i've got some information uh before i ask you all to hold a vote on this petition we have mr osborne here who is the petitioner uh this process began we were discussing before roughly a year ago it's taken a lot of effort to get to this point but we believe we have everything that is required this station do not just show you briefly the roads that we're talking about on this side all right so we're out here and falls are rough there's the green mansion uh well no is it no i'm sorry that's the green mansion it's probably your house this is green mansion we already have a section here of jenny sorry jenny green road that is county road already and the section that we are it actually comes up here a little

bit too it's a portion of jenny greenway that we're asking to be put on or the petitioners asking to be put on the county road list and it goes from here up to willis green drive and we're asking that willis green drive to be adopted as well this uh there are 69 lots on those two roads the requirements uh by the state statutes require that 55 of all property owners along that section along that road sign basically a uh agreement signed their own petition by property owners in support of the adoption of the roadway known as mission way or willis green drive to be adopted by grace county as a county road they swear and sign it the situation with this normally this would be a shorter process but with 69 lots

and people living all over the state and really a lot out of state too we had to send these out and i say we i prepared some of it but mr osborne has taken a great um has done a really great job over this past year getting these out following up we had to start an excel sheet just to see who we sent them to and who agreed what we got was uh the statute requires 55 percent of all property owners not just because there's people that own multiple lots too but the owners themselves so we had to figure out how many actual owners we had co-owners to get to that percentage it's 55 percent missed anyway we had 57 percent return in these petitions uh agreeing in our will screen drive we had 62 percent of the property owners of those lots affected send these back in and agree i received no objections i received no disagreements i received two phone calls with questions from people that owned property but ultimately we met that

major hurdle the second is that the road had been used by the general public without restrictions uh for the past 15 years this has been set up i can't remember the exact date but it's it's i believe platted out set up as a road for over 20 years and then the petitioner has signed that as part of that understanding the third part is that the road meets the minimum construction standards established by the fiscal court attached to behind the petition uh kenny the assistant road supervisor and steve uh the head road supervisor they went out inspected this area they did mention a couple areas that they would have to fix but they said overall it meets those minimum standards and they were okay with if you all voted to accept that and that is where you're at so i have submitted petition to the judge there and i am advising the court that all the statutory requirements have been met and i would ask for a vote on that matter and we have an order to

submit if you all devote that onto the accounting maintenance list discussion i'd like to encourage everyone to put this in because i've communicated a lot mr osborne as well on this and there's they need to be adopted in because a lot of people want to build houses on these lots and they have trouble getting financing because of the right of ways and it's a nice area it's a rural area and i think it'd be good for the area if we had some more homes more people come in that area so i just want to leave that with you silly question why are we adopting part of it and not the entire development um we're basically the mountain that we had declined was probably about the only one we had a chance to climb at this point probably because there's more property owners that they would have to get in touch with for them okay right just a question he's going to be part of it now and then trying to mister uh yeah in sections one and two there's 689 lots and there's probably roughly about 400 some owners and we do have four new houses being constructed right now but they're not being constructed on
