Meeting of July 7, 2022

[Music] thank you we've gotten and we pray that we could get some more and be your will thank you for this time that we can come together as County leaders and that the decisions made here tonight will be in a way that's pleasing in your sight we pray that you'll blessed each leader here tonight for the service that they provide for our community continue to keep everyone safe continue to bless us in Jesus name we pray amen amen yeah I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and judges are all right I call a meeting to order first I'd like to apologize to you all I had something come up over the weekend and I had to be out of town on Tuesday

during the meeting I attended a uh classmate because that classmate that I graduated the State Police Academy with he was one of the officers that was killed in Eastern Kentucky and so I felt that I needed to be there on Tuesday to support his family so uh that's that's what the reason for the meeting to be moved we're glad you went yeah it's a prayer for the family we hadn't been active uh first thing on agenda is approve the minutes from the previous meeting motion by Damon second by Tommy all in favor any opposed next we have approved payment of bills let me get let me get motion by mail second second by Brian all in favor any opposed next we have approved Treasures budget transfers as presented make a motion motion by Kevin second second by Darren all in favor any opposed thanks we have approved jailer's payment of bills make promotion motion by Tommy second by Brian all in favor aye any opposed we have approved

jailer's budget transfers as presented motion motion by who was that Darren second second by Tommy all in favor uh any opposed next we have an except Grayson County Sheriff's Office 2021 tax settlement any opposed next except Grayson County public libraries 2022-2023 budget I think I haven't emailed to you so a motion by Damon second by Kevin all in favor aye any opposed and next we have the second reading of ordinance related to the use of golf carts on certain designated County Roads Jeremy all right so um I think that some of you weren't here last time for this we had a original second reading and we end up having quite a bit of discussion concerning uh some of the details of how someone or a group or maybe a homeowner association reply uh if you did a road designated some other

little minor issues before I just do a summary of that I'd like to just kind of address some of the changes I made because there's a lot of ideas thrown out and I just want to make sure that we're kind of on the same page and you find it acceptable even before I read it based on our discussion it was hit which manuscripts were here so let's see the first thing is that the sheriff asked that you said that the aunts the off-site inspection site which would be the second physical page it should be 15 instead of ten dollars I changed that um the biggest issue with the applications is we want to kind of correct me if I'm wrong judge but we kind of wanted to differentiate between who was applying and what was required and so if you look at the second page of B there's uh on the second page B it's full-time residents that'll come

into play later when we're talking about how to tally the number of signatures on the petition full-time residents is defined as a piece of real property that contains a permanently a fixed personal residence home that's occupied year round but at least one owner of the property whose PDA County Property Tax Bill address listed is the same as the residence in question however RVs rental homes and the other homes used for short-term overnight rentals such as Airbnb type locations shall not fall in this category full-time resident is defined as an owner that needs requirements to be above before we move on to those applications in the Departments of that full-time resident in residence on that section to the same page number two be operated the golf cart can be operated by a person with a valid operator's license in his or her possession and be 16 years that was just a clarification so maybe a little bit more clear the third page under C application signatures I've got three categories you'll see on the next page the third

one is resident application any Grayson County resident my request edition of accounting or public roadway on which they reside as a designated County roadway by completing application uh continuing down and submitting the application to the judge executive's office which we board to the Grayson County Traffic Safety Committee for review the roadway requesting must meet all the requirements that set forth in this chapter every application under this category must include a petition signed by full-time residents the resident from at least 50 percent of the separate full-time residences on that roadway on said roadway all full-time residents count as one potential full-time resident signature for example if there's 10 full-time residents on X row which is a public road or County Road and you have the application would require at least five distinct full-time resident signatures from five distinct residences because you've got some there may be two people at one they just that one residence full-time residents residents we just count as one in the potential calculation of to see if they get up to

50 percent on the other two is when a group of full-time residents may join together a quest that multiple roadways within the same neighborhood in which they reside be declared designated County roadways without multiple applications for consideration in the same manner as one above with the exception that the application must contain the signatures of 50 a full-time residents will reside on any of the roads in the neighborhood Road group will be considered so if we have like a situation where a group of residents in the neighborhood uh want to apply to have three roads to be considered designated County Roads then for example if we have 40 full-time residences on X Y and Z roads and they're all public roads within the same neighborhood then it requires at least 20 or 50 distinct full-time residents from 20 distinct full-time residences anywhere on those three roads so it doesn't we don't have to have them 50 of each Road it's just from that area uh the third uh I hope to capture kind of what we were doing by streamlining

the process for when a homeowners association applies a homeowners association May request that multiple roadways within their neighborhood be designated County roadways by application without the necessity of full-time resident signatures if the application is submitted with the official minutes or a letter representing that the homeowner association has held a vote Farmers to leave being directed to file and application for consideration is that judges that pretty much what we talked about because even if Association if the people with an association vote not to request for the filing applications members of that same neighborhood could still go under two and ask that certain roads be container um and then I think that based on my conversation with the sheriff under Section Five it should be unlawful for any parent guarding the other adult person having care or custody over any minor child under 18 years of age knowing their permit such a minor child to violate this chapter in Karen regarding their adult person having to be care annual custody of any minor child under 18
