Any opposed? Then we have a first reading of the non-exclusive telecommunications franchise ordinance. Jeremy, do you have that? Yes, and it should be in your packet. Uh basically it's all in favor of the county's abilities to control uh franchise for internet providers. Um We were approached by Windstream's attorneys and also there's a resolution on the

next uh listing here on the agenda that would allow them just to continue uh because they're transitioning [snorts] and selling the company. Uh in doing that, they noticed that there's not a franchise ordinance and there's not, so just they have to go through the processes uh constitutionally, you know, we have different companies here that operate our right-of-ways, but we don't have an ordinance that gives them the power to do that. And so I got with Richard Ornstein and he reviewed it. He said that it's happening in a lot of counties, especially with Windstream, they're coming in filling that gap. So this ordinance uh in summary would be a non-exclusive franchise, just grant, basically building it into our ordinances that uh people can bid to for a franchise, which I don't even know what that means when they say bid, to be honest with you, because we don't get any tax money directly from that. It all goes to the state and supposed to build it down. So this ordinance would just set up the rules for if someone was to bid uh to be able to have a franchise here for internet

that we know what to expect our ability to basically deny that bid or approve that bid. It's something that they've asked for and I got with Rich and he said it's something that we need. And next we have uh Calvin Allen Road discussion. Jeremy, yes. Laura? Laura Milner? You here? You on Calvin Allen Road? I am. All right. Are are you here about it? You're the one want to be put on the minutes, right? — Right. Okay. Jeremy, go ahead. Well, I'll let her go ahead. — Okay. Go ahead with Calvin Allen Road. [clears throat] The the road I can't find any documentation that it was ever [snorts] accepted by the fiscal court. I requested it and the letter I got back from you stated that you couldn't find anything on it. My request today is that it be removed from the county road list and the GIS map and the known will match correct to reflect that it is a private road. Okay. So uh I think you you showed Kenny that it that uh a distance of it in 1987 we found in the records after a review of a 0.04 miles. Right now I think it's listed at 0.29. 0.291. And uh so we do have where part of it was adopted. Uh I spent about 6 to 7 hours going through all the

minutes. Uh as it does show up on a 2011 road map that we have, uh the list is a county road. And so between '87 and 2011 I looked to see if I could find minutes where it's been extended. I did not. Um however, uh you know, it in my research, Bruner v. Cooper, uh the Kentucky Supreme Court said that a road that has been treated as a county road, even if it doesn't have the specifics for the for this kind of distance, is still a public road and is still county road. Uh and so that's our position on this matter. The biggest issue we have here is that I understand that you took down a road sign. I didn't know that that was an issue now. It's an issue. Yes, it did happen. I did take it down. When I sent your letter letting you know that it was safe and stored and I when the officer showed up at dad's farm, he took it and put it down on the road. Right. So,
