Meeting of December 14, 2021

[Music] good afternoon welcome to the december 14th meeting of hardin county fiscal court i remind you this is a voting meeting if you have cell phones so please turn them off or put them in the vibrate mode we'll begin with the roll call if you would miss donnelly thompson here ronnie goodman yeah king judge barry here easter here doug goodman williams here clam wiseman here uh mr klim will lead us to invocation and mr wiseman the pledge if you please stand let's pray heavenly father we uh indeed thank you for this beautiful day that you've given us father we just uh thank you so much for the blessings that you have bestowed upon us and father we are we're uh citizens of the commonwealth that have heavy hearts right now we've seen devastation like we've never seen before this week and the loss of lives and the injuries and lives destroyed property lives as well as physical lives and father we just lift each and every one of those victims up to you and ask for your comfort and your strength

and father your encouragement probably we just lift those workers up that have come from everywhere to supply health and try to render aid and father we just ask that everyone continue to to remember them as they go through this order and father we just thank you for protecting us here in hardin county through this father father we just also ask that you go with us today through this meeting father just help us make wise decisions on the behalf of those who we serve plead guide and direct us in your son jesus name i pray amen please join me in the pledge i pledge allegiance to the fight of the united states of america and to the remarks under god indivisible with liberty and justice thank you manchester clem we appreciate those words and we all keep uh all of our brothers and sisters in the western part of the county and our thoughts and prayers

during this difficult time it's going to be a long road back for them but we'll all be there for we'll move on with the first item public hearing for road closing of quail roost road and conducting the public hearing today will be notice of today's hearing was published in the news enterprise december 4th in the publication december 4 and 5. pursuant to paris chapter 178 previously appointed viewers and their reports being made as part all right so the request before you all this afternoon is a road closing request from debbie and paige harden uh it is to close an undeveloped 60-foot right-of-way uh known as quail roost road and um the undeveloped right of me way

would be merged into the adjoining lot 1a of cedar grove acres section b and this is in radcliff kentucky off of spring meadow drive the exhibits winder into the record are krs 100.3244 a vicinity map zoning map aerial photographs the plat of cedar grove acres from 1969 an amended plat of cedar grove acres section b lots one and two that's from 2011 and then we have a proposed plat of lot 1a from this year we've done an analysis of the other closed sections clear roost road i've got some photographs of the site the staff report and comprehensive plan analysis planning commission resolution 2021-015 uh fiscal court resolution 2021-196 that was to appoint the viewers then also submit the viewers report and then a proposed resolution for today 2021-204 and then lastly the county's comprehensive plan and zoning awareness so 100 3244 states that the planning commission is required to review any proposed street closing with regards to the comprehensive plan

the vicinity map so we are up off deckard school road sort of south west of 313 near radcliffe city limits and this is cedar grove acre subdivision we're off of spring meadow drive so it would run off deckard school road and then dead end back there the zoning map here so we're zoned r1 urban residential that's the pill shade of green the portions of the map in white would be radcliffe city limits and then the brown shade there is actually an industrial holding zone that the county had in the event that radcliffe decided to expand their industrial park here's an aerial photograph so again it's a 60-foot right-of-way it's basically a quail roost road ran the back side of that subdivision the road was never built so they're wanting to merge that 60-foot right-of-way in with their adjoining lot here's the subdivision plot from 1969 cedar grove acres addition to hardin county and the right-of-way is there in green all right so here's an amended plat from

2011. what we did with this plaque was they started the road closing process but decided against it because they did not want to build the cul-de-sac currently the road just dead ends there's sort of a turnaround you'll see there with the neighbor's driveway but they ultimately decided to withdraw their road closing request but they did merge lots one and two together there into lab 1a and that was in 2011. so here is the request for today so essentially they want to merge that 60 foot right of way in with like 1a and then they want to re-subdivide it into lots 1b and 1c so we're kind of going back to what we used to have with two lots with the right-of-way closed and as part of their request they do understand that the subdivision regulations will require the construction of a 35-foot paved radius cul-de-sac here is that analysis i spoke of earlier so quail roost road essentially ran most of the back side of cedar grove acres there and we've previously closed all the other

sections in both 1994 and 1999. so this is the only remaining portion that's open and again just another kind of an enlargement there of the plat so county engineer charlie allen has been working with the surveyor to develop a cost estimate and the hardens would bond the construction of that cul-de-sac and then build it sometime next spring photographs of the property so again three signs have been posted one out at deckard school road and two back actually on the property since friday november 19th uh photograph here so this is the end of spring meadow drive quail roost road would be kind of back at the back side of the photograph the proposed cul-de-sac construction would kind of be there in the vicinity of our rav4 so there is currently just an existing gravel drive that's also sort of serving as a turnaround right now here i'm walking to the end of spring meadow drive and again the right way extends beyond the edge of pavement and just to give you an idea that's what quail roost road looks like there so

mature trees you can kind of make out the survey marker there on the right uh and then again this would be mr harden's farm that's within the city limits of radcliffe that would be just beyond the end of that right of way here i've turned around i'm looking back down spring meadow so here's our staff report and again the recommendation was to close the right-of-way citing goal 10 to improve the transportation system of hardin county so that would encourage the smooth flow of traffic throughout the county and then objective 10 to evaluate and close streets of record which are not being used have not been constructed or are unnecessary here is planning commission resolution 2021-015 this was approved back on the 16th of november planning commission sending a favorable recommendation to court to close the right-of-way this was the appointing of the viewers that the court did on 30th november and then i would be submitting this viewer's report
