On ordinances, the court gave second reading and adopted the FY 2021-22 budget (Ordinance 324), gave first reading to an amendment of the current year's budget (Ordinance 3214) reflecting additional road aid funds, insurance reimbursements, and Fort Knox mowing contract revenue, and approved Resolution 2021-087 formally closing the Wilma Street right-of-way discussed at the hearing. The consent agenda was also approved without changes.

For residents, the practical effect is that a small unused street right-of-way will be officially closed and merged into a residential lot, and the county's budget for the upcoming fiscal year is now finalized. Magistrates also used their comments time to remind residents to avoid distracted driving, drinking and driving, and texting while driving, and to promote a local entrepreneur networking event.

The meeting concluded with no further business, and the court adjourned, with the next meeting scheduled for June 8, 2021.

    and for all these things we uh give you the praise and the glory and it's the name of jesus christ i pray amen amen would you please join me in the pledge i pledge allegiance to the flight of the united states of america and the republic which expands on the nation under god indivisible with liberty and justice the first item we have today is a public hearing having to do with the closure of a 40-foot undeveloped right-of-way south of wilma street and conducting the public hearing is the county attorney miss timmy oldham thank you judge a request has been made by samantha and steve reynolds who i think are here to discontinue the 40-foot portion of the right-of-way south of wilma street and that's in the lincoln meadows subdivision just need to place a few things into the record that notice was placed by three signs on the property on may 5th and have been there since may 5th

    first class mail giving notice to all the adjacent property owners was given on may 7th of 21 and the ad for today's hearing was placed in the news enterprise on may 16 of 21. on may 11th of this year fiscal court appointed the viewers which were the engineer charlie allen the planning director adam king and the road department supervisor dwight morgan to make a report and to advise as to whether there would be any convenience resulting from the discontinuation of the road and so the law requires the planning commission to review this as well to make sure that it's in accordance with the county's comprehensive plan and so mr king if you want to come up and give us your report and since it's a hearing i do need to swear you in do you swear to tell the truth the whole truth and nothing but the truth i do thank you go ahead thank you all right so uh i'll try not to repeat too much what was said but it's a 40-foot undeveloped street 40-foot right away that was dedicated on a subdivision plat back in the 50s the reynolds want to close it to consolidate it with several other lots so they can build

    one home there this is the list of exhibits that will enter into the record so as jenny indicated state law says that close the street it has to first come before the planning commission so the planning commission held a a hearing it's more of a review for the request agreement with the comprehensive plan the planning commission did find that it was an agreement with the comp plan and is forwarding a favorable recommendation to fiscal court so as jenny indicated three signs have been posted on site in compliance with state law first class mailings newspaper notice in the news enterprise so where we are work east of i-65 out 62 in lincoln meadow subdivision the property is zoned urban residential r1 that's the pill shade of green you'll note you do have the blue there that's commercial properties along bardstown road just an aerial photograph here so we're at the back of lincoln meadow subdivision uh and actually this right-of-way was set up to where it could have joined mockingbird hills uh

    but that that connection was not used and never built so we are south of wilmeth street which is off gregory street so here's a copy of that plot from 1955 so the reynolds owns lot 177 through 183 and then an unnumbered parcel there that triangle but even if we merged those lots all together they would still have a difficult time fitting a home on this property because it would be a corner lot and they'd have a front set back off that right away there in pink so it's a 40 foot undeveloped right away for a future street and just zooming in here so this is the platinum mockingbird hills this came later in the 90s and you'll note there the arrow that's sort of the approximate location of this right-of-way and they actually platted a lot it wasn't used we didn't have all the technology at our fingertips in 92 that we do today to uh to make them make that connection here's an aerial photograph so again the right of way for the most part is cleared but there are several mature trees on the property and here's a copy of the proposed plat so again they would merge

    that 40-foot right-of-way along with the five or so lots and that unnumbered parcel to create one nice lot for a single-family home the right-of-way constitutes about a quarter of an acre i will point out here that the subdivision regulations we no longer allow dead end streets so there is sort of a hammerhead turnaround there but they would be dedicating a 50-foot radius right-of-way for a future cul-de-sac should the county and the road department ever have the funds to go back there and build that just a copy of the plaid over the aerial um so wilma street currently again it's a dead-end road it serves us access to nine existing homes uh photograph of the right-of-way here i'm looking uh from wilma street back towards mockingbird hills um so there not only is there a lot in the path of the right-of-way but they actually built the home right right in the path uh here i'm my backs to that home in mockingbird hills i'm looking back towards wilma street just a copy of our signage

    so here i'm looking sort of at the dead end of wilmuth as well as the right of way step back a little and this was another one so planning commission in fiscal court closed this this was another undeveloped away off of gregory street there right at wilma street and this one was kind of unique i took the photo in that we actually closed it but we preserved a pedestrian corridor there to get from one neighborhood to the other this is a little bit different situation there in that home and someone's backyard's right in the path this is our staff report that was presented to the planning commission also be part of the record here again we found it in compliance with goaltend to improve the transportation system of hardin county so that it encourages the smooth flow of traffic throughout the county and more importantly objective 10 to evaluate and close streets of record which are not being [Music] used and have not been constructed or are unnecessary next would be planning commission

    resolution 2021 2021-05 again forwarding a favorable recommendation to court this is a copy of the resolution passed a few weeks back appointing the viewers next would be our viewers report again we we find that it will not create an unnecessary hardship on anyone and then lastly for your all's consideration would be resolution 2021-087 that's all i've got happy to answer any questions you all might have anyone have questions this has never been used as a roadway in any way never never been used was never built it's essentially been functioning as a yard for both the properties on either side when you made notifications to the surrounding homeowners there was not any responses we did at the planning commission we did receive a phone call and actually the the adjoining neighbor on the other side came to the hearing but once she understood the process of obtaining part of it and doing survey work she wasn't interested thank you anyone else have questions okay thank you if anyone else is here
